The EDPB makes clear that Art. 3 of the GDPR is aimed at determining whether a particular processing activity, rather than an entity or person, is within the scope of the GDPR. Therefore, for controllers and processors located outside of the EU, some of the controller’s or processor’s processing activities may be within the scope of the GDPR, whilst others are not. On 4 May 2020 the European Data Protection Board (EDPB) adopted updated guidelines on consent under the GDPR ("New Guidelines"). The New Guidelines supersede the guidelines on consent originally adopted by the EDPB’s predecessor, the Article 29 Working Party, on 10 April 2018 (the 2018 Guidelines), and subsequently endorsed by the EDPB. The Guidance is the latest in a series of publications by the EDPB in this area. Den europeiska dataskyddsstyrelsen (EDPB) har nu presenterat efterlängtade rekommendationer om kompletterande åtgärder vid överföring av personuppgifter till tredje land. I tillägg till detta har de presenterat ett dokument om EU:s väsentliga garantier. The EDPB is an independent body which: ensures that EU law in this field – especially the General Data Protection Regulation (GDPR) and the Data Protection Law Enforcement Directive – is consistently applied in all countries that are covered by it promotes cooperation among the national data protection authorities When EDPB says “tools for transferring of data”, they mean legal basis for doing so.

At its 15th plenary meeting, the European Data Protection Board (“EDPB”) adopted the final guidelines on the territorial scope of the EU General Data Protection Regulation (“GDPR”) (the “Guidelines”), taking into account the feedback it received during the public consultation of its draft guidelines published on November 23, 2018.

The EDPB recommends that the DPA should specify that the controller must have access to the processor's premises and should be allowed to make recommendations in light of the results of the audit.
